Welcome to PlaylistsForYou B.V. ("PlaylistsForYou", "we", "us", "our"), registered in Utrecht, the Netherlands (Chamber of Commerce: 93964123). By using our website and services, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use our services.
PlaylistsForYou provides music promotion services by connecting artists with independent playlist curators and running promotional campaigns designed to reach real listeners.
2. Our Services
We offer:
- Playlist placement opportunities via independent curators
- Promotional campaigns (including paid advertising)
- Playlist discovery and matching based on genre, mood, and audience fit
We do not guarantee a specific number of streams, followers, saves, or placements. Music promotion results naturally vary.
3. No Fake Engagement Policy
PlaylistsForYou strictly prohibits:
- Bots, fake streams, or artificial engagement
- Click farms or incentivised listening
- Any activity that violates Spotify's Terms of Service
All promotion is focused on real listeners and organic engagement. If we discover that a campaign violates this policy, we will terminate the campaign immediately and may refuse future service.
4. Artist Responsibilities
By submitting music, you confirm that:
- You own or control all rights to the submitted music
- Your content does not infringe on third-party rights
- Your music complies with Spotify's content and platform rules
- You are responsible for ensuring your distributor and Spotify account are in good standing
5. Playlist Placement & Curators
Playlist placement decisions are made by independent curators based on their genuine opinion of your music. Placements are not guaranteed - they depend on song quality, genre fit, and the curator's audience. Curators may add or remove tracks at their discretion. We never force or pay for guaranteed placements, as this would violate Spotify's Terms of Service.
6. Payments, Results & Refunds
All campaign fees must be paid upfront unless otherwise agreed in writing.
No Guaranteed Results
Payment covers our campaign review, pitching, administration, and access to our independent curator network. It does not purchase or guarantee playlist placement, streams, listener numbers, advertising exposure, engagement, revenue, or any other specific outcome.
We do not promise a minimum number of placements, streams, followers, impressions, or other performance targets. Results depend on factors outside our control, including the quality and genre of the track, curator preferences, audience response, and overall fit with available playlists.
Full Refund for Zero Results
Your payment is protected in the following circumstances:
- During our review: We manually review each submitted track before launching a campaign. If we determine that your track is unlikely to be a suitable fit for our current curator network-for example, because of genre alignment or production quality-we may decline the campaign and issue a full refund.
- After the campaign: If your track is approved and the campaign is completed but receives zero curator playlist additions, we will issue a full refund.
For the purposes of this policy, a “result” means that at least one independent curator accepts your track and adds it to a playlist as part of the campaign.
If at least one curator adds your track to a playlist, the campaign is considered to have produced a result, and no refund will be available. Partial refunds are not offered where a campaign receives fewer placements, streams, or other outcomes than expected.
Independent Curators and Anti-Payola Policy
All playlist decisions are made independently by curators based on their own editorial judgment. Curators are not paid to guarantee placement, and campaign fees are not payments in exchange for playlist additions, streams, or preferential treatment.
We do not sell guaranteed placements, guaranteed streams, artificial engagement, or specific performance outcomes. Nothing in our service should be interpreted as pay-for-play, payola, or a promise that a curator will accept or promote a track.
Refund Processing
Approved refunds will be returned to the original payment method within 14 business days. Refunds made to credit or debit cards may take an additional 5–10 business days to appear on your statement, depending on your bank or card provider.
7. Results Disclaimer
We do not guarantee:
- Streams, followers, chart positions, or algorithmic placement
- Editorial playlist inclusion by Spotify
- Revenue or career outcomes
Music promotion involves risk and depends on factors beyond our control, including audience behaviour and platform algorithms.
8. Account Suspension & Refusal of Service
We reserve the right to:
- Refuse or terminate service if we suspect fraud, abuse, or Terms violations
- Remove content that may put our curators or platform at risk
- Refund and/or refuse service for any reason, if we feel we cannot achieve the desired outcome for your music
No refunds will be issued for accounts terminated due to violations.
9. Limitation of Liability
PlaylistsForYou is not liable for:
- Loss of revenue, streams, or opportunities
- Playlist removals by curators or Spotify
- Changes to platform algorithms or policies
Our total liability is limited to the amount you paid for the specific service in question.
10. Intellectual Property
All content on the PlaylistsForYou website, including text, graphics, logos, and software, is the property of PlaylistsForYou B.V. or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
Spotify and the Spotify logo are trademarks of Spotify AB. PlaylistsForYou is not affiliated with, endorsed by, or sponsored by Spotify.
11. Data Protection & GDPR
Our processing of personal data is governed by our Privacy Policy, which includes details about the data we collect, your rights under the GDPR, and how to exercise them. Key points:
- We process your data on the basis of consent, contract performance, and legitimate interest.
- You can withdraw consent for analytics and marketing cookies at any time via our cookie banner or by emailing [email protected].
- You have the right to access, rectify, erase, and port your data (see Privacy Policy for full details).
- Data transfers outside the EEA are covered by Standard Contractual Clauses.
12. Dispute Resolution
These Terms are governed by Dutch law. Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes will be submitted to the competent court in Utrecht, the Netherlands.
